How to resign as registered agent in Hawaii

To resign as registered agent in Hawaii, submit the completed Form X-9, Statement of Resignation of Registered Agent, to the Department of Commerce and Consumer Affairs, Business Registration Division (BREG). The statement of resignation form is on the BREG website in a fillable PDF format (see link below). The resigning registered agent will also have to send written notice of the resignation to the business. Written notice can be done through letter or email. The Statement of Resignation may be filed by mail, fax, online or walk in.

Filing fees may be paid by mailing in the form with a check or walking the form into the BREG office with check or credit card. To file by fax, the documents must include legible signatures, the amount of the charge, the sender’s credit card and contact information, and must specify regular or expedited review.
Make checks payable to Department of Commerce and Consumer Affairs.

Do you have to notify the Hawaii entity you’re serving as registered agent for before you resign or after?

When you resign as a business entity’s registered agent, you must notify the entity through a letter, email or other written form of the resignation. Hawaii does not require you to notify the entity prior to resignation, as long as you do it “promptly” after filing the resignation.

Is there a fee to resign as the Hawaii registered agent for a corporation, LLC, or other business entity?

There is a $25 filing fee to resign as a registered agent in Hawaii. The fee is the same to file online using Hawaii Business Express.
There is an additional $25 fee for expedited filing.

How long will it take the state to process the New Mexico resignation of registered agent filing?

Normal Processing takes approximately five business days.
Expedited Processing takes approximately one to three business days.

How long do you still have to serve as the registered agent after the filing?  How long will you have to legally accept service of process after you’ve resigned as agent?

The resignation will be effective on the thirty-first day after Form X-9, Statement of Resignation of Registered Agent, is filed or when a new registered agent is appointed for the entity.
