How to resign as a Maryland resident agent:
A resident agent may resign by drafting a letter of resignation. All you really have to include is the name of the entity and that you are resigning as its resident agent. The resident agent then has to send the signed original to the corporation or LLC and submit a photocopy of the letter to the Maryland State Department of Assessments and Taxation (SDAT). You can submit the photocopy of the resignation to the SDAT by mail, fax or in person.
The best way to submit a statement of resignation to the Maryland SDAT is to fax it. Since there is no fee to resign, you don’t have to pay the fax filing expedite fee that is usually required.
If you mail the letter of resignation to the Maryland SDAT, you just need to include a check for fees.
If you choose to file your documents in person, you have to be in line at the Maryland SDAT counter by 4:15 and pay the expedite fee for same day processing. If you file in person you can pay with check, cash, or money order.
All checks should be payable to the State Department of Assessments and Taxation.
Do you have to notify the Maryland entity you’re serving as resident agent for before you resign or after?
You do have to notify the entity, but it can be simultaneous with your submission of a copy of the letter to the SDAT. All this really means is that you will send the original signed resignation to the Maryland business and a photocopy to SDAT.

Normal Processing takes Maryland SDAT at least 8 weeks but this doesn’t really apply to the resignation, since there is no fee to fax file and have your resignation expedited. Faxed documents are processed in about 7 business days.
How long do you still have to serve as the resident agent after the filing? How long will you have to legally accept service of process after you’ve resigned as agent?
The resignation is effective at the time it is filed with the Maryland SDAT if the corporation or LLC has more than one resident agent. Otherwise, the resignation is effective ten days after it is filed with the SDAT.
