A registered agent may resign by filing two signed copies of written notice of resignation, with the Public Regulation Commission (PRC). There is no form resignation letter. New Mexico requires original signatures so you can only file by mail or in person.

The registered agent does not have to notify the entity. The PRC will mail a copy of the notice of resignation to the business immediately.

How long will it take the state to process the

Normal processing time for documents is up to fifteen days. When the PRC receives a statement of resignation, they send notice to the business immediately.

registered agent after the filing? In other words, how long will you
have to legally accept service of process after you’ve resigned as
agent?

The appointment of the resigning agent terminates thirty days after receipt of the notice by the PRC.
