The New York Department of State does not dissolve any businesses for not paying the biennial fee. If you voluntarily dissolve your New York LLC, you must petition the court for reinstatement.

A voluntarily dissolved New York LLC may only be restored to active status by a court order filed with the Department of State.

The only reasons you would need to start over with a new LLC would be if you requested dissolution and would rather start over than attempt to obtain a court order.

If you have missed filing your biennial reports your business status will change to “Past Due,” you can bring your business status back to active or good standing status at any time by paying the $9 fee.
