How long does trademark registration take?

Registration typically happens 10 to 12 months after the USPTO receives your application. It can take longer depending on backlog and what happens during examination.

Do you guarantee approval?

No. No one can. While we do everything we can to ensure trademark registration, and to inform you of potential issues ahead time, outcomes are ultimately at the discretion of the USPTO. Attorney-client relationship terms and conflict checks apply as described in our terms of service.

What if I need more than one class?

The USPTO charges $350 per class and our service includes your first one. We charge a total of $450 for each additional class (which includes the $350 USPTO fee).

How does filing with a lawyer save money?

The USPTO encourages attorney representation when filing because, ultimately, this can save you time and fees. To name a couple easy mistakes, applying with insufficient information is an extra $100 and including too many characters costs $200. After a couple simple errors that an attorney would’ve known to avoid, you could be out hundreds of dollars and your application could be significantly delayed.

What if I change my mind?

If you decide to cancel or stop the trademark registration process before your application is sent, we provide a partial refund based on where you are in the filing process. If you’re unsure whether to proceed, our attorneys can help advise you of your options.

What does the $599 include?

Our $599 price is per trademark registration application and includes: the filing fee for one class, review of your trademark, a clearance search, advice, submitting the application, tracking post-submission deadlines, and responding to most procedural office actions. It’s designed to cover the core filing work without surprise hourly billing.

What happens if the USPTO issues an office action?

Office actions identify issues a USPTO examiner has with an application. They must be addressed before the application can proceed. Most procedural objections in office actions are handled as part of our service, while substantive objections require additional attorney time. Law on Call can handle those issues for an additional fee. After discussing your options, we’ll provide an estimate of the cost to respond.
