Guidelines For Starting A Nonprofit Charity In Delaware

Do I have to register my nonprofit charity with the Delaware Attorney General?

Not in Delaware. Most nonprofit corporations are also charitable organizations, and most states have laws and regulations for registering your organization. Delaware Charitable Solicitation Act regulates and enforces fundraising practices, but it also states that Delaware has no registration and no annual renewal required for charities.

What are the fundraising rules in Delaware?

Misleading anyone in any way when asking for charitable donations is against the law.

  1. The fundraiser must identify him or her by name.
  2. The fundraiser must state if he is a paid solicitor or employed by one.
  3. The fundraiser must identify the charity.
  4. If asked, the fundraiser must be able to tell the person being solicited, the amount of the donation that will be used for charity and the amount kept by the fundraiser.
  5. No calls before 8 a.m. or after 9 p.m.

How do you file a complaint if I’ve been scammed?

File a complaint with the Consumer Protection Division of the State of Delaware Department of Justice, either online or by filling out and mailing in a consumer complaint form. An investigator from the office will contact you.
