How does a non-profit corporation in Utah receive an exemption from state corporate income and franchise taxes?

To obtain tax exempt status on corporate income and franchise taxes, a UT nonprofit corporation must first be deemed tax exempt by the IRS (501c status). Once the nonprofit organization has been granted 501c status, the state corporate and franchise tax exemptions are automatic-no paperwork needs to be filed with the state.

How does a UT non-profit obtain a sales tax exemption?

Utah nonprofit corporations can obtain an exemption on state sales tax if they have been granted 501c3 status by the federal government. To apply for the state exemption, nonprofits need to complete and submit Form TC-160 and a copy of the IRS’ Letter of Determination to the Utah State Tax Commission.

How does a non-profit in Utah obtain a property tax exemption?

Nonprofits in Utah need to apply to their local county tax assessor’s office to obtain a property tax exemption. Most likely, in order to receive the exemption, the nonprofit will need 501c3 status, but in most cases, 501c3 status is not required to apply.
