Georgia Tax Exemption For Nonprofit Corporations

TAX EXEMPTION FOR NONPROFITS IN THE STATE OF GEORGIA

Can my Georgia nonprofit be federally tax exempt?

Apply for 501c3 status with the IRS in order to become federally exempt. The IRS will send you a Letter of Determination.

Who is eligible for sales tax exemption in Georgia?

Usually there is no GA sales tax exemption to churches, religious, charitable, civic, and other nonprofit organizations. Your nonprofit in Georgia will have to pay taxes on all tangible personal property purchased.

Are there any exceptions for GA sales tax exemption?

There are limited tax exemptions from Georgia sales and use tax for qualifying nonprofits including:

  • licensed nonprofit orphanages
  • adoption agencies
  • maternity homes
  • in-patient general hospitals
  • mental hospitals
  • nursing homes
  • blood banks
  • private schools
  • any combination of grades 1-12, nonprofit groups whose primary purpose is to raise money for public libraries
  • organizations that provide services to the developmentally disabled

How do I start the process of becoming GA sales tax exempt?

After you have received your Letter of Determination (501c3 Status) from the IRS and your certificate of incorporation from the Georgia secretary of state, attach those documents and your formation documents to the applicable, initial exempt organization tax return filed with the State of Georgia.

Is my nonprofit exempt from income taxes?

You can submit Form 3605 (The Application for Recognition of Exemption) to the Georgia Income Tax Division. Along with the form you will need to submit your Georgia nonprofit’s Articles of Incorporation, bylaws, statement of activities in Georgia, and a copy of your Letter of Determination from the IRS.
