How do I qualify my foreign non profit corporation in Texas?

Get your out-of-state non profit authorized with the Secretary of State before you begin operating in Texas. There are penalties for jumping the gun.

You qualify a foreign non profit by filing the Application for Registration for a Nonprofit Corporation or Cooperative Association in duplicate with the filing fee to the Texas Secretary of State. You can deliver it by mail, fax or in person.

If your corporate name is not available in Texas, you can file your application under an assumed name by filing at the same time the Assumed Name Certificate and include an extra $25 filing fee.

What is the cost to register a foreign non profit in Texas?

The filing fee is $25. Pay with a check or money order, cash or credit card. If fax-filing or paying by credit card, include the Payment Form from the department. Texas adds a 2.7% convenience fee for credit card payments, making the filing fee $25.68.

How long does it take for Texas to process my foreign qualification?

Texas takes about a week to process your filing. You can request one-day service for an additional $25.

Do I need a Certificate of Good Standing from my home state?

No.
